Privacy statements for clients and other data subjects

1. Collection and storage of personal data as well as type and purpose and their use

When you contact us or engage our services, we collect the following information:

  • Salutation, first name, last name,
  • e-mail address,
  • mailing address,
  • Phone number/fax number
  • Information necessary for the assertion and defence of rights within the scope of your engaging our services or for the fulfilment of a planned or existing business relationship,
  • Information required for the official notarial function.

 

These data are collected for the following purposes: 

  • to identify you as our client, business partner, party to a deed, supplier or claimant,
  • to be able to advise and represent you appropriately, where necessary,
  • in order to safeguard your interests as litigants, in particular in notarisations and other official notarial transactions,
  • for correspondence,
  • to fulfil our obligations,
  • for invoicing purposes,
  • for the handling of any existing liability claims as well as the assertion of any claims against you.

 

The data processing is carried out either at request or upon our initiative and is required according to Art. 6 para. I s. 1 lit. b GDPR or the stated purposes for the appropriate processing of the client engagement or contract and for the mutual fulfilment of obligations arising from this. To the extent that data processing serves the official notarial function, it is carried out in accordance with Art. 6 para. I s. 1 lit. c and lit. e GDPR.

The data are erased when they are no longer necessary for the purposes for which they were collected or otherwise processed. They will be erased at the latest by the end of the statutory retention periods, unless longer storage is necessary to fulfil legal obligations pursuant to Art. 6 para. I s. 1 lit. c and lit. e GDPR or to assert, exercise or defend legal claims, or unless you have consented to further storage pursuant to Art. 6 para. I s. 1 lit. a GDPR. 

2. Disclosure of data to third parties

Your personal data will only be transferred to third parties for purposes listed below. This includes, in particular, disclosure to opponents in litigation and their representatives (in particular, their counsel) as well as courts and other public authorities. The data disclosed may be used by the third party exclusively for the aforementioned purposes. Statutory duties to maintain confidentiality remain unaffected. The extent it involves data subject to the solicitor-client privilege, it will only be passed on to third parties in consultation with you.

3. Your rights as a data subject

You have the right: 

  • According to Art. 7 para. 3 GDPR, at any time to withdraw your consent already provided to us. This has the consequence that in the future we may no longer continue the data processing based on this consent;
  • according to Art. 15 GDPR, to request information about your personal data processed by us. In particular, you many request information concerning the purposes of the processing, the category of personal data, the categories of recipients to whom your data have been or will be disclosed, the intended duration of the retention, the existence of a right of rectification, erasure, limitation or objection, the existence of a right of appeal, the origin of your data, if not collected by us, and the existence of automated decision-making including profiling and, where appropriate, meaningful information on its details;
  • according to Art. 16 GDPR, to immediately request the correction of incorrect or incomplete personal data stored by us;
  • according to Art. 17 GDPR, to demand the erasure of your personal data stored by us, unless processing is necessary for exercising the right to freedom of expression and information, for fulfilling a legal obligation, for reasons of public interest or for asserting, exercising or defending legal claims;
  • according to Art. 20 GDPR, to receive your personal data, which you have provided to us, in a structured, standard and machine-readable format or to request the transfer to another data controller, and
  • according to Art. 77 GDPR, to, to register a complaint with a supervisory authority. As a rule, you may contact the supervisory authority of your normal place of residence or workplace or of our law offices.

 

4. Right of objection 

To the extent your personal data are processed on the basis of legitimate interests according to Art. 6 para. I s. 1 lit. f GDPR, you have the right to object to the processing of your personal data according to Art. 21 GDPR if there are reasons for doing so that arise from your particular situation.

1. Collection and storage of personal data as well as type and purpose and their use

When visiting our website www.ettrich.de, the browser used on your user device automatically sends information to the server of our website. This information is temporarily stored in a so-called log file. The following information is collected without your intervention and stored until automated deletion:

  • IP address of the requesting computer,
  • Date and time of the access,
  • Name and URL of the retrieved file,
  • Website from which access occurs (referrer URL),
  • the browser used and, where applicable, the operating system of your computer, as well as the name of your access provider.

 

The data mentioned are processed by us for the following purposes:

  • Ensuring a smooth connection of the website,
  • Ensuring convenient use of our website,
  • Evaluation of system security and stability as well as
  • for other administrative purposes.

 

The legal ground for the data processing is Art. 6 para. 1 s. 1 lit. f GDPR. Our legitimate interest arises from the purposes listed above for the collection of data. Under no circumstances do we use the collected data for the purpose of drawing conclusions about your identity.

In addition, we use cookies and analysis services when you visit our website. For more detailed explanations, please refer to Items 3 and 4 of this privacy statement.

2. Disclosure of data

Your personal data will not be transferred to third parties for any purposes other than those listed in Item 1 and occurs exclusively within the scope of statutory regulations.

3. Cookies

We use cookies on our website. These are small files automatically created by your browser and stored on your device (laptop, tablet, smartphone, etc.) when you visit our website. Cookies do not cause any damage to your user device, nor do they contain any viruses, Trojans or other malware.

The cookie stores information generated respectively in connection with the specific user device. This does not mean, however, that we will gain direct knowledge of your identity.

The use of cookies serves, on the one hand, to make the use of our website more pleasant for you. For example, we use so-called session cookies to recognise that you have already visited individual pages on our website. These are deleted automatically upon leaving our website.

In addition, to optimise user-friendliness, we also use temporary cookies, which are stored on your user device for a specified period of time. If you visit our site again to use our services, it is automatically recognised that you have already visited us before, along with the inputs and settings you have made, so that you do not have to enter them again.

On the other hand, we use cookies in order to statistically track the use of our website and to evaluate it for the purpose of optimising our service for you (see Item 4). When you visit our website again, these cookies enable us to automatically recognise that you have already visited our site before. These cookies are automatically deleted after a defined period of time.

The data processed through cookies for the specified purposes are necessary for the preservation of our legitimate interests, as well as those of third parties according to Art. 6 para. 1 s. 1 lit. f GDPR.

Most browsers automatically accept cookies. You can configure your browser, however, so that no cookies will be stored on your computer or a message always appears before a new cookie is created. However, if you disable cookies completely, you may not be able to use all the functions of our website.

4. Analysis Tools

Tracking tools
The tracking measures listed below and used by us are implemented on the basis of Art. 6 para. 1 s. 1 lit. f GDPR. With the use of tracking measures, we seek to ensure a needs-based design and continuous optimisation of our website. On the other hand, we use cookies in order to statistically track the use of our website and to evaluate it for the purpose of optimising our service for you. These interests are to be considered legitimate within the meaning of the aforementioned provision.

Matomo
We use the open source software Matomo for the analysis and statistical evaluation of the use of the website. Cookies are used (see Item 3). The information generated by the cookie about website usage is transmitted to our servers and summarised in pseudonymous usage profiles. The information is used to evaluate the use of the website and to enable a needs-based design of our website. The information is not passed on to third parties.

Under no circumstances is the IP address associated with other data relating to the user. The IP addresses are anonymised so that identification is not possible (IP masking).

5. Rights of data subjects

You have the right:

  • according to Art. 15 GDPR, to request information about your personal data processed by us. In particular, you many request information concerning the purposes of the processing, the category of personal data, the categories of recipients to whom your data have been or will be disclosed, the intended duration of the retention, the existence of a right of rectification, erasure, limitation or objection, the existence of a right of appeal, the origin of your data, if not collected by us, and the existence of automated decision-making including profiling and, where appropriate, meaningful information on its details;
  • according to Art. 16 GDPR, to immediately request the correction of incorrect or incomplete personal data stored by us;
  • according to Art. 17 GDPR, to demand the erasure of your personal data stored by us, unless processing is necessary for exercising the right to freedom of expression and information, for fulfilling a legal obligation, for reasons of public interest or for asserting, exercising or defending legal claims;
  • to demand the restriction of the processing of your personal data in accordance with Art. 18 GDPR if the accuracy of the data is disputed by you, the processing is unlawful, but you refuse its erasure and we no longer need the data, yet you need it to assert, exercise or defend legal claims or you have objected to the processing in accordance with Art. 21 GDPR;
  • according to Art. 20 GDPR, to receive your personal data, which you have provided to us, in a structured, standard and machine-readable format or to request the transfer to another data controller;
  • according to Art. 7 para. 3 GDPR, at any time to withdraw your consent already provided to us. This has the consequence that in the future we may no longer continue the data processing based on this consent and
  • according to Art. 77 GDPR, to, to register a complaint with a supervisory authority. As a rule, you may contact the supervisory authority of your normal place of residence or workplace or of our law offices.

 

6. Right of objection

To the extent your personal data are processed on the basis of legitimate interests according to Art. 6 para. 1 s. 1 lit. f GDPR, you have the right to object to the processing of your personal data according to Art. 21 GDPR if there are reasons for doing so that arise from your particular situation or the objection is aimed towards direct advertising. In the latter case, you have a general right of objection, which will be implemented by us without stating a particular reason.

7. Data security

Within each website session, we use the widely-distributed SSL (Secure Socket Layer) procedure in connection with the highest respective encryption level supported by your browser. Normally, this is 256-bit encryption. In case your browser does not support 256-bit encryption, we revert to 128-bit v3 technology instead. You can tell whether an individual page of our website is transmitted in encrypted form by the closed depiction of the key or lock icon in the lower status bar of your browser.

We also use suitable technical and organisational security measures to protect your data against accidental or intentional manipulation, partial or complete loss, destruction or against unauthorised access by third parties. Our security measures are continuously improved in accordance with technological development.
